1. Acceptance of Terms
By creating an account on MyVoice or using the MyVoice platform (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Service.
MyVoice is operated by Balcostics Ltd., a company incorporated in Jamaica.
2. Eligibility
- You must be at least 13 years old to use MyVoice
- A valid Jamaican phone number (+1876) is required for account verification
- You must provide accurate information during registration and profile completion
- You may not create or use an account on behalf of another person without their consent
3. Your Account
- One account per phone number. Duplicate accounts may be suspended.
- You are responsible for maintaining the security of your account and the device used to access it.
- You must notify us immediately of any unauthorized use of your account.
- You may delete your account at any time through your profile settings. Account deletion anonymizes your personal information while retaining anonymized survey responses for aggregate data purposes (see our Privacy Policy).
4. User Content
“User Content” includes survey responses, poll votes, comments, topic submissions, and any other content you provide through the Service.
- Your Ownership: You retain ownership of your individual survey responses and comments.
- License Grant: By submitting content, you grant Balcostics Ltd. a worldwide, non-exclusive, royalty-free license to use, aggregate, anonymize, and distribute your responses as part of anonymized datasets. Your individual identity is never disclosed.
- Content Moderation: All user-created topics and content are subject to AI-powered moderation. Content that violates our Acceptable Use policy (Section 6) may be removed without notice.
5. Points Economy
- Points are earned by completing surveys, daily check-ins, referrals, and other platform activities.
- Points have no monetary value and cannot be exchanged for cash or transferred outside the MyVoice platform.
- Points may be used within the platform for features such as accessing gated data, creating targeted questions, and entering prize draws.
- Balcostics Ltd. reserves the right to adjust point values, earning rates, and the points economy at any time.
- Fraudulent point accumulation (e.g., through automated submissions, duplicate accounts, or speed-running surveys) may result in point forfeiture and account suspension.
- Prize draws: Winners are selected through a weighted random algorithm. Prizes are subject to availability and may have additional terms.
6. Acceptable Use
You agree not to:
- Submit false, misleading, or spam responses to surveys or polls
- Use automated tools, bots, or scripts to interact with the Service
- Create multiple accounts to circumvent rate limits or earn duplicate rewards
- Post hate speech, threats, harassment, or discriminatory content
- Attempt to access other users' accounts or personal data
- Exploit bugs, vulnerabilities, or platform errors for personal gain
- Use the Service for any unlawful purpose under Jamaican law
- Interfere with or disrupt the Service's infrastructure or performance
Violations may result in content removal, point forfeiture, temporary suspension, or permanent account termination at our sole discretion.
7. Data & Privacy
Your use of MyVoice is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with the Jamaica Data Protection Act 2020.
By using the Service, you consent to the collection and anonymized use of your survey responses as described in the Privacy Policy. Anonymized data may be included in datasets provided to organizations, universities, NGOs, and research institutions.
8. Intellectual Property
- The MyVoice platform, including its design, code, branding, logos, and AI-generated content, is the property of Balcostics Ltd.
- Survey questions created by the MyVoice team or through AI tools are the property of Balcostics Ltd.
- User-created topics remain associated with the creating user but Balcostics Ltd. retains a license to host, display, and include associated responses in datasets.
- You may not copy, reproduce, or redistribute MyVoice content without written permission.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We do not guarantee the accuracy, completeness, or reliability of AI-generated insights
- Points and rewards are provided at our discretion and may be modified or discontinued
- We do not guarantee uninterrupted or error-free access to the Service
- Survey results and platform statistics are for informational purposes and should not be relied upon as scientific research without independent verification
10. Limitation of Liability
To the maximum extent permitted by Jamaican law, Balcostics Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount of points redeemed by you in the 12 months preceding the claim, or JMD 10,000, whichever is greater.
11. Termination
- You may terminate your account at any time by deleting it through your profile settings or by contacting us.
- We reserve the right to suspend or terminate your account for violation of these Terms, suspicious activity, or extended inactivity (over 24 months).
- Upon termination, your personal data will be handled in accordance with our Privacy Policy.
- Any earned points are forfeited upon account termination, unless applicable law requires otherwise.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Jamaica. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Jamaica.
13. Changes to Terms
We may revise these Terms at any time by posting the updated version on this page with a new version number and effective date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. For material changes, we will provide notice through the platform.
